1. Acceptance of Terms
By accessing or using Textiful, Textiful.co (“Service”) as a trading name of Goodbrand PTY LTD, you agree to comply with these Terms and Conditions (“Terms”). If you do not agree, do not use the Service. These Terms apply to all visitors, users, and customers.
This Acceptable Use Policy (“Policy”) is part of the Textiful Terms of Service and applies to all use of the Textiful Services and Technology (including but not limited to SMS, MMS, webchat, voice, and other messaging channels made available through the Services). By using Textiful, you agree to comply with this Policy.
The purpose of this Policy is to ensure that communications sent through Textiful reach their intended recipients while protecting against spam, fraud, abuse, and unlawful content.
2. Service Description
Textiful.co provides:
All-in-one business texting for marketing, two-way SMS, reminders, and communication.
Tools and features accessible via https://textiful.co.
We reserve the right to modify or discontinue the Service without notice.
Account Registration
3. Account Registration
You must provide accurate information when creating an account.
You are responsible for:
Maintaining account security.
All activities under your account.
Notifying us immediately of unauthorized access.
Accounts must not be shared or transferred.
User Responsibilities
4. User Responsibilities
You agree not to:
Use the Service for illegal activities or violate third-party rights.
Upload harmful content (e.g., malware, hate speech).
Reverse-engineer, scrape, or exploit the Service.
Impersonate others or interfere with Service operations.
Consent Requirements
5. Consent Requirements
1.1 Standard Consent
You must obtain valid, express consent from a recipient before sending any message (“opt-in”).
Consent must be specific to your brand, your use, and the type of messages you will send. Blanket or transferred consent (e.g., purchased lists) is not valid.
You must retain proof of consent (such as a signed form, digital opt-in record, or timestamp).
If you do not message a recipient within a reasonable time after receiving consent, you must reconfirm consent before sending your first message.
1.2 Alternative Consent
Consent may also be obtained in the following circumstances:
Individual-Initiated Contact: If an individual messages you first, you may reply to that conversation only. Additional communication requires further consent.
Prior Relationship: You may message an individual if:
They provided you with their phone number,
They took an action that triggered the communication (e.g., booking, purchase, or alert setup), and
They have not opted out.
Acceptable examples include receipts, appointment reminders, delivery updates, OTPs, or service confirmations. Marketing content is not allowed under this category.1.3 Ongoing Messaging
For recurring or periodic messages, you must:
Provide a clear opt-out mechanism (e.g., “Reply STOP to unsubscribe”).
Respect user preferences regarding frequency.
Periodically reconfirm consent, as required by local regulations or industry best practices.
2. Sender Identification
Every message must clearly identify you as the sender (the entity that collected consent), except in follow-up messages within an active conversation.
3. Opt-out Requirements
The first message you send must include standard opt-out instructions (e.g., “Reply END to unsubscribe” or industry-standard alternatives such as STOP, STOPALL, UNSUBSCRIBE, QUIT).
Users must be able to revoke consent at any time by replying with a valid opt-out keyword.
After an opt-out, you may send a single confirmation message, but no further communications unless the user re-subscribes.
4. Prohibited Content
You may not use the Services to send or promote content that includes or relates to:
Spam or Unsolicited Messaging
Commercial promotions, advertising, or announcements without valid consent.
Purchased or rented contact lists.
Illegal, Harmful, or Fraudulent Activity
Unlawful content or activity that violates the rights of others.
Fraudulent goods, services, or promotions.
“Get-rich-quick” schemes, ponzi or pyramid schemes, or misleading investment opportunities.
High-risk financial services (e.g., payday loans, cryptocurrency, third-party auto/mortgage loans).
Third-party lead generation services.
Debt collection or forgiveness services (including consolidation or credit repair).
Restricted substances (e.g., cannabis, CBD, or prescription drugs not available over-the-counter).
Gambling.
“SHAFT” categories: Sex, Hate, Alcohol, Firearms, Tobacco (including vaping).
Phishing, pharming, or other malicious activity.
Infringing Content
Content that infringes intellectual property or proprietary rights.
Offensive or Abusive Content
Harassing, defamatory, obscene, invasive, or otherwise objectionable material.
Harmful Content or Technology
Viruses, malware, spyware, or other content intended to damage or intercept systems or data.
Evasive Content
Content designed to bypass filtering or detection mechanisms, including misspellings and non-standard opt-out language.
5. Prohibited Messaging Practices
Message Abuse: No use of bots, spam systems, falsified headers, false identities, or misleading sender information.
Snowshoeing: No spreading similar or identical messages across multiple numbers to evade detection.
URL Shorteners: Do not use shared public link shorteners (e.g., Bitly, TinyURL). Use a dedicated domain instead.
6. Payment Services Restrictions
If you use Textiful Payment Services, you may not process payments for prohibited industries or activities as defined in the Textiful Payment Service Terms.
7. Reverse Engineering & Security
You may not:
Modify, reverse engineer, decompile, or attempt to extract source code or non-public APIs.
Circumvent security measures or rate limits.
Remove proprietary notices.
8. Scope of Use & Fair Use
All Services (including Bulk Messaging, Automations, Bulk Uploads, and the Textiful API) are subject to scope-of-use limits defined in your Subscription Documentation and/or at https://www.textiful.co/pricing/
.Services labeled “unlimited” are intended for normal business use only. Excessive or abnormal use may result in suspension.
9. Monitoring & Enforcement
Textiful reserves the right, but not the obligation, to monitor communications and investigate violations of this Policy.
Textiful may suspend, restrict, or terminate accounts, remove content, or disable access if violations are found.
Suspected unlawful activity may be reported to law enforcement, regulators, or other authorities, and may include disclosure of customer information.
10. Reporting Violations
If you become aware of any violation of this Policy, you must immediately notify Textiful at hello@textiful.co
and provide reasonable assistance in resolving the issue.
Payments & Subscriptions
6. Payments & Subscriptions
Paid plans require valid payment via approved gateways (e.g., Stripe, PayPal).
Fees are non-refundable unless required by law.
We may change pricing with 30 days’ notice (email or in-app).
Automatic renewals apply; cancel anytime via your account dashboard.
Intellectual Property
7. Intellectual Property
All Service-related content (logos, software, design) is owned by Textiful.co or licensors.
You may not copy, modify, or resell our materials without written permission.
Termination
8. Termination
You may close your account at any time.
We may suspend/terminate accounts for:
Violations of these Terms.
Prolonged inactivity.
Fraudulent or harmful behavior.
Upon termination, your data may be deleted per our Privacy Policy.
Disclaimers & Limitations
9. Disclaimers & Limitations
The Service is provided “as-is.” We disclaim all warranties (express or implied).
We are not liable for:
Indirect, incidental, or consequential damages.
Loss of data, profits, or business opportunities.
Third-party actions or service interruptions.
Maximum liability limited to fees paid to us in the past 6 months.
Governing Law & Disputes

These Terms are governed by the laws of Victoria, Australia.
Disputes will be resolved through binding arbitration (not courts).
Class actions are waived.
Changes to Terms
11. Changes to Terms
We may update these Terms periodically.
Continued use after changes constitutes acceptance.
Material changes will be notified via email or Service alert.
